Terms & Conditions

These Terms & Conditions apply to all photography sessions booked with The Dayographer. By booking a session, you agree to the following terms.
1. Definitions
- “Photographer” refers to The Dayographer, the sole provider of the photography services.
- “Client” refers to the individual or family booking the session.
- “Session” refers to the booked photography experience, including “Out and About” and “Adventure” packages.
- “Images” refer to the photographs captured and delivered as part of the session.
2. Booking & Payment
- Full payment is required at the time of booking and is processed securely via Calendly and Stripe.
- Your session is not confirmed until payment has been successfully completed.
- All payments are non-refundable, except in cases where the Photographer cancels the session (see Section 6. Rescheduling & Cancellations).
3. Package Definitions
Home Sweet Home Sessions
Scope:
- Designed for in-home lifestyle photography, capturing authentic, everyday moments in the Client’s home.
- Ideal for family interactions, playtime, reading, baking, bath time, and other natural routines.
- The Photographer moves through the session unobtrusively, capturing candid moments with minimal direction.
Duration:
- Standard session time is up to 3 hours.
Photographer’s Role:
- Captures the real-life moments of your family’s day at home, focusing on connection and storytelling.
- Provides gentle guidance if needed, but no formal posing.
- Does not involve studio setups, artificial lighting, or extensive props.
Not Included:
- Formal portrait sessions or staged setups.
- Large-scale events or extended family gatherings.
- Home organization, cleaning, or styling assistance.
Out and About Sessions
Scope:
- Designed for short, local outings within a familiar environment.
- Locations may include cafés, playgrounds, libraries, short walks, or local parks.
- Focuses on everyday moments and relaxed family time outside the home.
Duration:
- Standard session time is up to 4 hours.
Photographer’s Role:
- Captures natural, candid moments of the outing.
- Provides light assistance (e.g., carrying small bags, handing out snacks).
- No logistical planning or complex scheduling involved.
Not Included:
- Entry fees or paid activities (e.g. admission to attractions)
- Locations requiring extensive travel or multiple stops
- Large-scale outings or events.
Adventure Sessions
Scope:
- Designed for full-day or half-day outings that require planning and travel.
- Locations may include zoos, beaches, theme parks, museums, or other large attractions.
- Captures big, exciting moments and milestone experiences.
Duration:
- Standard session time is up to 6 hours.
Photographer’s Role:
- Captures the full experience, including transitions between activities.
- Provides hands-on support (e.g., carrying larger bags, organizing belongings, assisting with food/snack breaks, applying sunscreen).
- Helps ensure a smooth, stress-free experience for the Client.
Additional Costs & Considerations:
- The Client must cover any entry fees, tickets, or permits required for the Photographer.
- Sessions requiring extensive travel (30+ km round trip) may incur additional travel fees.
- Multi-location sessions must be agreed upon in advance and may incur additional charges.
4. Travel & Additional Fees
- Travel up to 30 km round trip from Doncaster East is included.
- Additional travel is charged at $1 per km.
- Multi-location sessions must be agreed upon in advance and may incur additional fees.
- If a session requires overnight stays, the Client must cover the cost of accommodation and reasonable expenses.
5. Session Breaks & Timing
The Photographer will take reasonable breaks during sessions lasting longer than 2 hours.
- For Adventure sessions, the Photographer is entitled to a 30-minute meal break for sessions exceeding 5 hours.
- Break times do not count toward the total session duration.
6. Rescheduling & Cancellations
Client Rescheduling
- Rescheduling is permitted with at least 12 hours’ notice.
- If the Client reschedules more than once, a 15% rescheduling fee will apply.
- Rescheduling is subject to the Photographer’s availability.
Client Cancellations
- The retainer is non-refundable.
- If the Client cancels within 7 days of the session, 15% of the total session fee will be retained.
- No-shows or same-day cancellations will be charged the full session fee.
Photographer Cancellations
- If the Photographer is unable to attend due to illness, injury, or unforeseen circumstances, the Client will be offered:
- A full refund of all payments made, or
- The option to reschedule at no additional cost.
7. Weather Policy
- Outdoor sessions are subject to weather conditions.
- If weather conditions make the session unsafe or unworkable, the Client may:
- Reschedule at no additional cost, or
- Move to an indoor location if suitable.
- If the Client chooses to proceed despite inclement weather, the Photographer is not responsible for any negative impact on the final images.
8. Image Delivery & Usage
- Final edited images will be delivered within 10 days of the session.
- The number of images provided is at the sole discretion of the Photographer, based on the flow of the session and the moments captured.
- Images will be delivered via an online gallery, where the Client can view and download high-resolution files.
- Raw or unedited images will not be provided under any circumstances.
9. Copyright & Usage Rights
- The Photographer retains full copyright of all images.
- The Client is granted personal usage rights, including printing, sharing with family, and posting on social media (with credit where possible).
- The Client may not edit, alter, or apply filters to the images.
- Commercial use (e.g., publishing, advertising, or selling) requires written permission from the Photographer.
10. Model Release & Privacy
- The Client agrees that the Photographer may use images for portfolio, website, marketing, and social media unless otherwise requested in writing.
- If the Client prefers privacy, they must notify the Photographer before the session in writing.
11. Client Responsibilities
- The Client is responsible for ensuring all participants arrive on time and ready for the session.
- If young children are involved, the Client should bring snacks, drinks, and any necessary comfort items.
- The Photographer is not responsible for coaxing reluctant participants into cooperation but will make every effort to capture natural interactions.
12. Liability & Indemnification
- The Photographer is not liable for any injuries, damages, or incidents that occur before, during, or after the session.
- The Client assumes all responsibility for their own safety and the safety of minors under their care.
- The Photographer is not responsible for lost, stolen, or damaged personal belongings during the session.
13. Force Majeure
- The Photographer is not responsible for delays, cancellations, or failures to perform due to events beyond their control, including but not limited to:
- Natural disasters
- Extreme weather
- Government restrictions
- Pandemics or public health emergencies
- Acts of God
If a session is affected by such circumstances, the Photographer and Client will discuss a suitable rescheduling or refund arrangement.
14. Agreement & Acceptance
By booking a session with The Dayographer, the Client acknowledges that they have read, understood, and agreed to these Terms & Conditions.
